It is a trap that catches out first-time developers and seasoned property investors alike: you find an old suburban section, do a quick mental calculation based on its total square meterage, and conclude it is the perfect site for a high-yield, four-townhouse development. The land looks flat, open, and clear.
Yet, when the civil engineers and licensed surveyors finish their initial site feasibility assessments, the maximum yield drops from four down to just two dwellings.
In the New Zealand development sector, raw land area is a highly deceptive metric. A site’s true yield is determined not by its physical boundaries, but by invisible infrastructure easements, vehicle tracking geometries, and natural hazard overlays.
1. The Vehicle Maneuvering Tax (Tracking Curves & Accessways)
To cram four townhouses onto a single site, you usually need to arrange them in a tandem (front-to-back) or multi-unit terrace configuration. This instantly triggers strict vehicle access and parking rules under the local District Plan.
- The Access Width Mandate: For a single home, a basic 2.5-meter driveway is fine. However, when you scale up to 3 or 4 units, council rules typically force the driveway width to increase to a minimum of 3.0 to 3.5 meters to accommodate emergency service vehicles and multi-car traffic. That extra meter of width down the entire length of the site eats up massive amounts of valuable building footprint.
- The 90th Percentile Tracking Curve: Councils require all vehicles to be able to exit a multi-unit site in a forward gear—reversing out onto a public road from a multi-unit development is generally prohibited. To prove this, designers must run standardized tracking curves (simulating a 90th percentile car or rubbish truck) on the site plan. The concrete turning knuckles and clearance spaces required to let a car spin around can easily swallow up the exact footprint where your third and fourth units were supposed to sit.
2. Invisible Assets: Public Drainage and Infrastructure Easements
A section can look like a completely clear patch of green grass, but beneath the surface sits a network of public infrastructure that you legally cannot build over.
- Zone of Influence and Protection Easements: If a council wastewater main or stormwater pipe runs across your backyard, it carries a strict legal easement. Generally, you cannot build any permanent structural foundations within 1.5 to 2.5 meters of either side of that pipe.
- The Depth Consequence: Even if you obtain an engineering “bridge-over” approval to lay foundations near the asset, your structural piles must be driven deep enough to sit completely below the pipe’s “zone of influence.” The massive structural engineering costs often make building close to the line financially unviable, forcing you to shrink your building envelope.
3. Hydrology Hurdles: Overland Flow Paths and Catchments
With intense weather events placing extreme stress on civil infrastructure across New Zealand, stormwater management has become a critical gatekeeper for development density.
- Overland Flow Paths (OLFP): When the council’s GIS mapping identifies a natural depression where rainwater flows during a 1-in-100-year storm event, that zone is flagged as an Overland Flow Path. You are legally forbidden from blocking, redirecting, or building over this path. If an OLFP cuts diagonally across your 800m² section, it can effectively cut your usable building envelope in half.
- Hydraulics & Downstream Capacity: To build four homes, your civil engineer must prove the public network can handle the massive increase in impervious surface runoff. If the downstream stormwater network is already at capacity, the council may reject a high-density build unless you install incredibly expensive, high-volume underground detention tanks—a cost that often kills the project’s financial viability, forcing you to scale back to a lower-impact, two-unit footprint.

Before signing an unconditional sale and purchase agreement, front-load your due diligence by pulling a comprehensive Land Information Memorandum (LIM) and consulting a civil engineer to map out your true, unencumbered building envelope.
